Introduction
When we talk about marijuana, many people are surprised that hemp and marijuana are lumped together.
For many, hemp and marijuana are two different products.
However, biologically and in the government’s view, hemp and marijuana are both forms of cannabis.
That is why hemp, although it contains less than 0.3% THC, has been banned for a long time in the United States and Louisiana
Recent Legislation
The passage of the 2018 Farm Bill does clarify the legal status of hemp a little.
Although marijuana is still illegal on a federal level, there is now a distinction being made between hemp and marijuana.
In short, federally hemp is now legal to grow and cultivate.
However, the law in many states, such as Louisiana still have to catch up.
CBD from Hemp
For most patients and medical providers, we are most interested in the production of CBD from hemp.
As you know, CBD has many potential medical benefits, including anti-inflammatory, immune modulation, anti-seizure, and anxiolytic effects.
The good news for patients is that CBD from hemp is chemically indistinguishable from CBD from marijuana and readily accessible over-the-counter and online.
While you do miss out on some of the potential entourage effect from CBD that’s produced from marijuana, there is often a substantial cost savings when using CBD from hemp.
Unfortunately, the bad news is that the federal government, and the state of Louisiana, has taken the stance that CBD sold over-the-counter or online is still illegal.
So please realize that there could be legal ramifications for possessing or using CBD in Louisiana.
Summary
It’s unfortunate that the government does not realize the potential for CBD to help people and continue to insist that CBD is illegal.
Hopefully things will change in the near future to allow patients who use CBD to stop hiding in the shadows and have wide and legal access to this product.
