Traveling With Medical Marijuana

Introduction

Hi there.  It’s Dr. Chou and thanks for reading my latest article.

Today we’re going to answer a very common question.

“Can I travel with medical marijuana.”

Louisiana Law

Louisiana law allows a patient who is participating in the state’s medical marijuana program to possess marijuana in the forms allowed by state law.

There is no provision in the law for individual parishes or cities to enact stricter guidelines as far as patient use and possession of medical marijuana.

So in summary, as long as you are within the confines of Louisiana, you should be able to use and possess your medical marijuana whether you are in New Orleans, Baton Rouge, or any other city or parish.

Federal Law

Keep in mind that federal law still considers possession and use of marijuana to be illegal, even for medical purposes.

You may not realize it, but there are many circumstances where you may interact with the federal government.

Going on a cruise, travel on a plane, or crossing state lines are some of the situations where you will be interacting with the federal government and you could potentially face federal penalties for possessing marijuana in these instances.

Other States

Because medical marijuana laws vary from state to state, other states may not recognize that you are a patient in the Louisiana medical marijuana program.

Some states have reciprocity for medical patients, other states allow recreational possession, while others may not allow any marijuana possession at all.

Keep in mind that when you are in a state, you are subject to their laws and regulations.

Other Countries

Some countries are very permissive of marijuana use.  Other countries mandate strict penalties, such as prison time, for even small amounts of marijuana possession.

Please be especially careful when traveling to countries in the Middle East and Asia have criminal justice systems very different from the United States.

Summary

Unfortunately, because of differences between Louisiana law, federal law, and the law in other states, travel with medical marijuana can be problematic and requires a lot of advanced planning.
